User / Member / Customer / Provider / Person Must have legal consent from their respected guardian if under the age of 18. All transactions must obey local US, UK, Australian and most if not all international UN or EU laws.

WELCOME TO EASY POCKET MONEY

By visiting or using the Services available from the domain and sub-domains of www.easypocketmoney.com (the “Site”) you are contractually agreeing to the following terms and conditions, including those available by hyperlink (collectively, the “Terms and Conditions” or “Agreement” or “Privacy Policy”). We suggest that you consult the Terms and Conditions linked information regularly for updates. We reserve the right to revise the Terms of Conditions and all linked information from time to time in our sole discretion by updating this posting or any linked information. Unless otherwise provided in such revision, the revised terms will take effect when they are posted.

As used in the Terms and Conditions:

“Member” means a person or legal entity that registers for an Account with Easy Pocket Money for use of the Easy Pocket Money Services available from the Site

“User” means (1) a person who is a Member, using the Site on his or her own behalf, or (2) a person who is using the Site on behalf of a Member that is a company or organization

“Service Provider” means a Member that offers and delivers Provider Services to Buyers on the Site

“Buyer” means a Member that investigates and purchases Provider Services on the Site

“Visitor” means a person who is only visiting the Site (i.e., not a Member or User)

“you” means the Visitor or Member accessing the Site or using the Services on the Site on his or her own behalf; or, if the Services on the Site are used on behalf of a company or organization, “you” means the Member for which the Services are used and the User who accesses the Site on behalf of such Member (and such User represents that he or she has the authority to do so on the Member’s behalf).

MODIFICATION OF SERVICE

Easy Pocket Money reserves the right to modify, add, or remove all services and features of the website at any time. 

MODIFICATION OF AGREEMENT

This Agreement may be modified by Easy Pocket Money at any time.  It is your responsibility to periodically review any updates to this agreement to determine if any modifications affect you or your business. 

INDEMNIFICATION

You agree that you shall indemnify, defend and hold harmless Easy Pocket Money and its officers, directors, employees, agents, owners and shareholders from and against any costs, expenses (including, among other expenses, reasonable attorneys' fees and expenses), losses, damages (specifically including, but not limited to, incidental, consequential, exemplary, special, indirect or punitive damages), suits, claims or liabilities incurred and arising from or relating to your use of Easy Pocket Money services.

EXPORT LAW

Products, Services and technical data delivered by Sun may be subject to US or other national export control laws, and may be subject to export or import regulations of other countries. Licensee undertakes to comply strictly with all such laws and regulations, and acknowledges that it has the responsibility to obtain all necessary licenses to export, re-export or import as may be required after delivery to Licensee

REMOVAL FROM NETWORK / TERMINATION OF SERVICE

Easy Pocket Money has the right to instantly cancel, delete, or otherwise disable your account or portions of your account, with or without warning.

TERMINATION FOR IMPROPER USE

Infractions of this Agreement or the acceptable use policies set forth in this Agreement by you can result in immediate termination of your accounts without reimbursement.  Easy Pocket Money may make exceptions in the case of individual abusive users.  This decision is left entirely to the discretion of Easy Pocket Money.

$10.00 for one new & unique account per person

Referral Commissions

$10.00 for 10 or more emails

MEMBERSHIP FEES

1. Easy Pocket Money users may have a single BUYER profile and multiple SERVICE PROVIDER (PROVIDER) profiles. BUYER profiles are FREE  and as such have no membership fee.  Easy Pocket Money charges membership fees for each active PROVIDER profile. PROVIDER membership fees are renewed according to the User's selected renewal options, unless deactivated by the subscribing User.  If automatic membership renewal is requested by the User, Easy Pocket Money will automatically charge the membership fee to the User's designated payment method and you authorize us to charge such payment method for the appropriate membership fees and amounts stated. Easy Pocket Money reserves the right to increase membership fees or to institute new fees at any time, upon reasonable notice posted in advance on this Website.

2. Downgrades to a less expensive membership or cancellation of any membership will not result in any refund or credit of fees already paid. Membership fees are charged up-front and no refunds or credits will be given upon cancellation or downgrades. The cancellation of a membership will go into effect at the end of your current billing cycle.

WARRANTIES

1. While Easy Pocket Money makes reasonable efforts to provide its services without errors or inaccuracies on our website, we make no representations as to the accuracy, completeness, error free nature of services/material on the website, or timeliness of those materials/services, and you should not rely upon it.

2. The services provided by Easy Pocket Money are "AS IS," "WHERE IS."  Easy Pocket Money does not make any express or implied warranty of any kind, including, without limitation, any express or implied warranty of merchantability or fitness for a particular purpose for the services to be provided by Easy Pocket Money under this agreement.

3. In addition, Easy Pocket Money makes no representations or warranties of any kind as to the reliability, identity, or quality of any user or third party you may encounter on our website, nor does Easy Pocket Money make any representations or warranties as to the accuracy of any postings made on the website by any user. 

4. Each party represents and warrants that it has the right and/or full corporate power and authority to enter into this Agreement.

LIMITATION OF LIABILITY

You agree to use this website, any or all of our services provided on it, or links from our website at your own risk.  Easy Pocket Money is not responsible or liable for any loss whatsoever that you may incur by using our services or any material from our website.

Under no circumstances, shall easy pocket money or anyone else involved in administering, distributing or providing Easy Pocket Money services, be liable for any indirect, incidental, special or consequential damages, including, without limitation, loss of revenues or lost profits or damages that result from the use of or inability to use easy pocket money services, mistakes, omissions, interruptions, deletion of files or e-mail errors, defects, viruses, delays in operation or transmission, failure of performance, theft, destruction or unauthorized access to easy pocket money records, programs or services, or losses or damages incurred by you from visiting third party websites that you access through our website, even if Easy Pocket Money has been advised of the possibility of such losses. 

Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states, Easy Pocket Money liability is limited to the greatest extent permitted by law.  In no event shall Easy Pocket Money's liability to you exceed the aggregate amounts paid by you to Easy Pocket Money for its services during the previous six months.

PROTECTION OF COPYRIGHTS AND TRADEMARKS

The Website contains trademarks and other material furnished by Easy Pocket Money, its licensors, and other users. You should assume that everything you see or read in publicly viewable areas of the Website that was not furnished or received by you (such as images, photographs, illustrations, text and other materials) ("Website Content") is copyrighted unless otherwise noted. You may not sell, reproduce, distribute, modify, display, publicly perform, prepare derivative works based on, repost or otherwise use any of the Website Content in any way for any public or commercial purpose without prior written consent of Easy Pocket Money or the rights holder. You may not use the Website Content on any other website or in a networked computer environment for any purpose except your own personal viewing. In order to protect Easy Pocket Money and its Licensor's trade secrets, you agree that you will not 'reverse engineer' any Website Content consisting of downloadable software, unless specifically authorized by the trade secret owner or otherwise permitted by law.

RELATIONSHIP OF PARTIES

1. Your relationship and correspondence with users on Easy Pocket Money site, including the development and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such user. You agree not to hold Easy Pocket Money liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such users of the website.

2. By accepting this agreement, you acknowledge that Easy Pocket Money does not provide any development tools or delivery mechanisms for any project deliverables between users.

OWNERSHIP

The website and all intellectual property rights related to the website, including but not limited to copyrights, trademarks, service marks and any feedback left by users on the website, are owned or licensed by Easy Pocket Money, and all right, title and interest in the website and the related intellectual property rights remain the property of Easy Pocket Money. You may not reproduce, reverse engineer, decompile, disassemble, modify or create derivative works with respect to the website or any related intellectual property, including any services provided via the Easy Pocket Money website.

NO ASSIGNMENT

You shall not sell, transfer, or assign this Agreement without the prior written consent of Easy Pocket Money.  Any unauthorized transfer or assignment shall be null and void; provided, however, that any such assignment shall not relieve user of its obligations under this Agreement.  Easy Pocket Money has the right to transfer or assign this Agreement to any other person or entity without your consent.

ACCEPTABLE USE POLICY

As consideration for use of the Easy Pocket Money website pursuant to this Agreement, you agree to the following stipulations relating to acceptable use of the Easy Pocket Money website.  You agree not to use the Easy Pocket Money website to:

1. Intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, any regulations having the force of law.

2. Impersonate any person or entity, including, but not limited to, a Easy Pocket Money official or employee or falsely state or otherwise misrepresent your affiliation with a person or entity;

3. Employ misleading e-mail addresses or falsify information in the header, footer, return path or any part of any communication, including e-mails, transmitted through the Easy Pocket Money website;

4. Upload, post, e-mail, otherwise transmit or post links to any content that you do not have a right to transmit under any law or regulation or under contractual or fiduciary relationships (such as inside information, or proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

5. Upload, post, e-mail or otherwise transmit or post links to any content that facilitates hacking;

6. Upload, post, e-mail, otherwise transmit or post links to any content that infringes any patent, trademark, service mark, trade secret, copyright or other proprietary rights of any party or contributing to inducing or facilitating such infringement.

7. Upload, post, e-mail, otherwise transmit or post links to any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes" or any other form of solicitation, except in those areas that are designated for such purposes;

8. Upload, post, e-mail, otherwise transmit or post links to any material that contains software viruses, worms, trojan horses, time bombs, trap doors or any other computer code, files or programs or repetitive requests for information designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or to diminish the quality of, interfere with the performance of, or impair the functionality of the Easy Pocket Money website;

9. Upload, post, e-mail, otherwise transmit or post links to any content, or select any member or user name or e-mail address, that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, pornographic, libelous, invasive of privacy or publicity rights, hateful or racially, sexually, ethnically or otherwise objectionable;

10. Upload, post, e-mail, otherwise transmit or post links to any content that promotes illegal activity, including without limitation the provision of instructions for illegal activity;

11. Collect or store personally identifying information about other users for commercial or unlawful purposes;

12. Upload, post, e-mail or otherwise transmit or post links to any material, or act in any manner that is offensive to these stipulations of acceptable use.

Easy Pocket Money also reserved the right to trigger other clauses in this agreement.

AVOIDING COMMISSIONS OR FEES

Shall deam breach of this Terms & Conditions or Service document and Easy Pocket Money shall reserve the right to recover lost commision, fees or income, or damage caused to it's reputation.

USER CONTENT RESTRICTIONS

Advertising

Users are prohibited from advertising your website on Easy Pocket Money. Any URL posted in a bid, project description, or the message board, must relate to a project on Easy Pocket Money. An example of a permissible URL: User's portfolio or resume' page.

Bidding

Service Providers can only place bids that equal the total amount of money they are requesting for the project. You cannot post an hourly bid or any other abnormal type of bid. This applies to Service Buyers too. Service Buyers cannot create projects that directly or indirectly require Service Providers to place hourly or other abnormal bids. The only exception, for both Service Buyers and Service Providers, is when the project is featured. See featured project information at page.

Featured Projects

The following conditions are here to prevent abuse of the "Featured project" feature on Easy Pocket Money. The maximum amount of money a Service Provider can receive for a Featured project, through the Easy Pocket Money system, without being charged a fee, is $2,500. Any amount received above $2,500 will be subject to the regular fee of 10%. Note that this condition only applies to money received with the Easy Pocket Money system; you can receive more than $2,500 for a single Featured project, without being charged a fee, if the payment is made outside of Easy Pocket Money. If this condition applies to a payment you received on Easy Pocket Money, you must notify us of the amount so that we can apply a 10% fee to the amount above $2,500. Failure to notify us could result in temporary account suspension.

Hirer agrees that:

Hirer will not redistribute any of the content on Easy Pocket Money.

Hirer ill not use Hirer's Account to post false or misleading project descriptions. Hirer will not post project descriptions that are inappropriate to Easy Pocket Money's audience, viewers, or visitors in the judgment and discretion of Easy Pocket Money.

Hirer agree to pay featured project fee if project posted should have been posted as featured.

Hirer will not falsify Hirer's own or any other identity.

Hirer will comply with all Easy Pocket Money's policies.

Freelancer agrees that:

Freelancer will not redistribute any of the content on Easy Pocket Money.

Freelancer will not falsify Freelancer's own or any other identity.

Freelancer will comply with all Easy Pocket Money policies.

General Restrictions

Users (Hirers and Freelancers) will not use any automated collection mechanism or any manual process to monitor or copy the web pages comprising the Easy Pocket Money web site or the content contained therein without the prior written permission of Easy Pocket Money.

Users (Hirers and Freelancers) will not distribute unsolicited commercial messages ("spam") through User's account.

Users (Hirers and Freelancers) will not contact employers or freelancers through our site or through information gained from our site with the intent of subverting them from using our services.

Users (Hirers and Freelancers) will not engage in personal attacks, negative or other unfair criticism or other forms of discourteous and unprofessional online conduct or practices.

Users (Hirers and Freelancers) will not create multiple user accounts to avoid fees, suspension or bad ratings on Easy Pocket Money.

DISPUTE RESOLUTION

Any disputes regarding arrangements between Freelancers and Hirers remain solely between Hirers and Freelancers. We are not involved in any transactions between You and any other users of Easy Pocket Money. You acknowledge and agree that Easy Pocket Money will not be a party to any such dispute or be obligated to take any action or refrain from taking any action toward resolving any such dispute. If you have a dispute with any other users of the Site, you hereby release Easy Pocket Money from any and all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, related to such a dispute.

GOVERNING LAW, JURISDICTION AND VENUE

Interpretation and enforcement of this Agreement shall be governed by the laws, in order of most applicable & chosen by Easy Pocket Money on an adhoc basis.

You consent to these jurisdiction/s, for any action arising out of or relating to your use of Easy Pocket Money services.  These courts, shall have exclusive jurisdiction over all such actions.  If any provision of this Agreement shall be held invalid or unenforceable in whole or in part for any reason, such provision shall be ineffective to the extent of such invalidity or unenforceability without in any manner affecting the validity or enforceability of any of the remaining provisions of this Agreement.

ATTORNEY FEES AND COSTS

If any action is brought by you against Easy Pocket Money under this Agreement, and Easy Pocket Money prevails, Easy Pocket Money shall be entitled to recover from you its actual costs and reasonable attorney fees and all other litigation costs, including expert witness fees, and all actual attorney fees and litigation costs incurred in connection with the enforcement of a judgment arising from such action or proceeding.  The provisions of the preceding sentence shall be severable from the provisions of this Agreement and shall survive the entry of any such judgment.
